No. Since 1 May 2026, India’s Promotion and Regulation of Online Gaming Act, 2025 bans online games played for money, and that includes Aviator and every other crash game played for cash. The law punishes the companies that run, pay for or advertise these games. It does not punish players.

The 30-second version

India’s Promotion and Regulation of Online Gaming Act, 2025 got presidential assent on 22 August 2025, and its rules came into force on 1 May 2026. It bans “online money games”, which means any online game where you put in money hoping to win money back. Real-money Aviator is one. Running such a game can mean up to 3 years in jail, a fine of up to one crore rupees, or both. Advertising one can mean up to 2 years and up to 50 lakh rupees. Banks and payment firms must not process the money. The minister in charge told Parliament that players are victims and will not be penalised. Aviator predictor apps and celebrity ads aimed at Indians are scams.

🚫 India’s ban on real-money games started on 1 May 2026, and Aviator is covered

Real-money Aviator has been illegal to offer in India since 1 May 2026. Parliament passed the Promotion and Regulation of Online Gaming Act, 2025 on 20 and 21 August 2025, and it got presidential assent on 22 August 2025. The government’s press release of 22 April 2026 says the rules “will come into force on 1st May, 2026”. The Act bans online money games: games where you pay money or stakes hoping to win money. Spribe’s Aviator played for cash fits that exactly, and so does every other crash game played for cash.

The ban does not depend on whether a game is skill or luck. That argument used to matter in India. It does not matter under this law. If you pay in money and can win money out, it is an online money game.

The rules also set up a new regulator, the Online Gaming Authority of India. It is part of the Ministry of Electronics and Information Technology (MeitY). It decides whether a game counts as a money game, and the rules give it 90 days to do so. E-sports and social games with no money at stake are allowed. A money game cannot be passed off as an e-sport. The rules say so in plain words.

⚖️ Operators face up to 3 years in jail, and players face no penalty

The Act punishes the people who run, fund and promote money games, not the people who play them. The government’s press note on the bill lists up to 3 years in jail, a fine of up to one crore rupees (10 million rupees), or both, for offering a money game or handling its payments. Advertising one can bring up to 2 years in jail and a fine of up to 50 lakh rupees. On 20 August 2025, IT minister Ashwini Vaishnaw told the Lok Sabha: “Players of these games are victims and they won’t be penalised.”

Bank or payment firmHandles money for an online money gameUp to 3 years in jail, up to ₹1 crore fine, or both
Advertiser or promoterAdvertises an online money gameUp to 2 years in jail, up to ₹50 lakh fine, or both
Repeat offenderCommits the same offence again3 to 5 years in jail and ₹1 crore to ₹2 crore fine
PlayerPlays the gameNo penalty listed

The press note also says the key offences are “cognisable and non-bailable”. That means police can arrest without a warrant, and bail is not automatic. This applies to operators and promoters. Company bosses can be held to account too.

No penalty does not mean no risk. The Act blocks the money route. Banks and payment firms must not process these payments. Offshore Aviator sites have no Indian licence, so there is no Indian regulator to complain to if a site keeps your balance. Our crash game withdrawals guide explains what happens to money at unlicensed sites.

📝 For the record: The penalty figures come from the Press Information Bureau’s press note on the bill and its 30 April 2026 release. The minister’s words are as reported by Business Today on 20 August 2025.

📵 Aviator apps, websites and ads are now blocked in India

Aviator apps, websites and adverts aimed at Indians now break the law, and the government is blocking them. MeitY told the Lok Sabha that 8,376 betting and gambling website links had been blocked or acted on by 28 March 2026, with more than 4,800 of them after the Online Gaming Act passed, according to Medianama’s report of 4 April 2026. On 25 April 2026, MeitY also told VPN companies not to help people reach blocked betting sites.

  • Apps and sites: Any real-money Aviator app or site open to Indians is offering a banned game. The government can order it blocked under Section 69A of the IT Act.
  • Payments: UPI, cards and bank transfers to these sites are the “financial transactions” the Act bans. The PIB release says the rules stop banks and payment systems from handling them.
  • Ads and influencers: Advertising a money game is its own offence, with up to 2 years in jail. This covers ads for Aviator sites and apps.
  • VPNs: MeitY’s 25 April 2026 advice was aimed at VPN companies, not users. Medianama reported that it did not mention any penalty for people who use a VPN.

Blocking has not made Aviator ads disappear. They move to new links, new apps and new Telegram channels. Spribe does not publish a standalone Aviator app anywhere, so any “Aviator app” download is made by someone else. Our crash game apps guide shows how to tell a casino wrapper from malware.

📝 For the record: Blocking figures are from MeitY’s answer to a Lok Sabha question, as reported by Medianama on 4 April 2026. They count all betting and gambling links, not Aviator alone.

🔮 Aviator predictor scams aimed at Indians sell something that cannot work

Aviator predictor apps and signal groups aimed at Indian players are scams, because Spribe’s Aviator fixes each crash point before the round starts. A March 2025 investigation by Decode found more than 2,000 active Meta ads pushing Aviator with fake celebrity endorsements, AI voices of Shah Rukh Khan and Virat Kohli, and at least 75 YouTube channels selling promotion slots. One Telegram group with over 12,000 members promised users they could “recover 15,000 rupees by investing just 5,000”.

Aviator decides each round from a server seed plus seeds from the first three players in the round. The result is sealed with a hash before the plane takes off. No app on your phone can see it. Our Is Aviator Rigged? guide shows how to check a round yourself.

Try the game at the top of this page. Guess over or under 2x for 10 rounds. At Aviator’s published 97% RTP, a round reaches 2x about 48.5% of the time, so guessing gets you roughly half right. A predictor app does no better.

⚠️ Scam alert: The Indian versions of this scam follow one pattern. A video or ad uses a famous face. It points to a Telegram channel. The channel sells a “predictor” or a paid “VIP signal”, or gives it away free and pushes a sign-up link to an offshore site. Since 1 May 2026 that offshore site is also offering a banned game, so you have no Indian regulator on your side if it keeps your money. Decode’s investigation has the details. Our Aviator predictor guide and signal group guide show how the money is made.

🏛️ The Supreme Court challenge has not paused the ban

The Online Gaming Act is being challenged in India’s Supreme Court, but no court has paused it. Cases filed in the Karnataka, Madhya Pradesh and Delhi High Courts were moved to the Supreme Court on 8 September 2025. The Act came into force on 1 May 2026 as planned. Supreme Court Observer’s case page, updated on 2 July 2026, showed no stay on the Act and a hearing listed for 5 August 2026 before a bench headed by Chief Justice Surya Kant.

Until the Supreme Court rules otherwise, the ban on real-money Aviator stays in place. You can follow the case on Supreme Court Observer.

❓ Frequently asked questions

Is Aviator legal in India?

Not for real money. Since 1 May 2026, the Promotion and Regulation of Online Gaming Act, 2025 bans online money games in India, and real-money Aviator is one. Offering it can mean up to 3 years in jail and a fine of up to one crore rupees.

Will I be arrested for playing Aviator in India?

The Act has no penalty for players. IT minister Ashwini Vaishnaw told the Lok Sabha on 20 August 2025 that players are victims and will not be penalised. The penalties are for operators, payment firms and advertisers.

When did the Aviator ban start in India?

The Act became law on 22 August 2025. Its rules were notified on 22 April 2026, and both came into force on 1 May 2026.

Do Aviator predictor apps work in India?

No. Spribe’s Aviator fixes each crash point with seeds and a hash before the round starts, so no app can see it. In March 2025 Decode found over 2,000 Meta ads and a Telegram group of 12,000+ members selling fake Aviator wins to Indians.

Is the free Aviator game on this page legal?

The game on this page takes no money and pays no money, so it is not an online money game under the Act’s definition. It is a guessing game to show that crash rounds cannot be predicted.
